Foreign Driving Licence in India: Validity Rules (2026)

Quick Answer: A foreign driving licence is not a substitute for an Indian driving licence, and Parivahan publishes no validity window for one. Diplomats may apply for the Indian licence directly on Sarathi; everyone else takes a learner's licence first. Section 9(3) of the Motor Vehicles Act can exempt a foreign licence holder from the driving test, so ask your RTO.

This is for NRIs moving back, OCI cardholders, expats and students who hold a licence from elsewhere. What a foreign driving license in India gets you is narrower than most expect, so here is the Ministry of Road Transport and Highways' position.

Is a foreign driving licence valid in India?

Not as a substitute for an Indian licence, and not by conversion. The Ministry's answer to "How Foreign Driver's License holder or defence personnel obtain Driver's License?" is a route, not a recognition: it sends a foreign licence holder to Sarathi to apply for a new driving licence.

That settles foreign driving licence validity in India in practice: your home-country card is not the document the Regional Transport Office (RTO) licenses you on, though it can earn you an exemption from the test. The wording sits on Parivahan's new driving licence FAQ.

Do you need an International Driving Permit as well?

India's own IDP works the other way round. Parivahan's International Driving Permit page says the permit "will be issued to an applicant who holds a valid Indian Licence and who is a resident of India", on Form 4A. It is what India gives its residents for driving abroad.

Nothing there treats a permit issued by another country as a stand-in for an Indian licence. On an international driving permit India-side, your district RTO is the office that decides.

How long can you drive in India before you need an Indian licence?

Parivahan's driving-licence pages publish no such period, and nor do the state transport departments. So plan around the application, not a deadline: a non-diplomat must hold the learner's licence 30 days before the driving test, which puts the real gap at over a month. Start on Sarathi before you need the car, and ask your RTO what it expects meanwhile.

How do you convert a foreign driving licence to an Indian licence?

You do not convert it. You apply afresh on Sarathi, through the Driving Licence menu's New Driving Licence option, the route Parivahan names for a foreign licence holder.

  1. Open the Sarathi state-selection page and choose the state where you live.
  2. If you are not a diplomat, take the learner's licence first. Parivahan is explicit: a non-diplomat "has to apply for Learner's License, before proceeding for Driving License".
  3. Hold it at least 30 days. It stays valid six months, so do not let it lapse.
  4. Open Driving Licence → New Driving Licence and enter your learner's licence number and date of birth.
  5. Fill the application. Parivahan's live form is the consolidated Form 2, which covers a driving licence under rule 14. Then book the test appointment.
  6. Visit the RTO on the date given with your originals and fee slip. The licence follows by speed post.

What documents do you need?

Follow the list your RTO publishes, because the set is state-administered. Three items are stated centrally:

Do you have to take a driving test?

Not always. Section 9(3) of the Motor Vehicles Act, 1988 says no test of competence is necessary where you prove you hold a licence for that class of vehicle "issued by a competent authority of any country outside India", provided you meet the medical condition in section 8(3) and no disability makes your driving a danger. Maharashtra's transport department lists the same exemption. The licensing authority applies it, so carry your foreign licence in original and ask your RTO how it treats it.

Who can apply: NRIs, OCI cardholders or foreign nationals living in India?

Anyone in those groups can apply if they live here. Parivahan's answer is "Yes, you can apply for Driving License in India", and the only split it draws is diplomatic status. The residence condition comes from the Act: sections 8(1) and 9(1) send you to a licensing authority in the State "in which he ordinarily resides or carries on business", and Form 2 asks a foreign national for proof of legal presence in India as well as proof of residence. A tourist visa does not meet that.

So an OCI cardholder, an NRI on an Indian passport and a foreign national on a work visa all take the same Sarathi route. What changes is which Indian address you can evidence, and which office has jurisdiction.

How long is an Indian driving licence valid once you have it?

Your age at issue or renewal sets it, under section 14 of the Motor Vehicles Act as amended in 2019: a private licence issued before you turn 30 runs until you are 40, not for a fixed term.
