Supreme Court: Compassionate Appointment Cannot Override Rules

The Supreme Court of India has remarked that compassionate appointments are made on the principle of giving aid to the affected families after the death of a government employee. These appointments may, however, be exercised subject to certain rules and policies. They are time-bound and cannot be exercised after several years have elapsed.

What Is A Compassionate Appointment?

A compassionate appointment is a rule that allows the beneficiary of a deceased government employee to find a job to meet some necessities that may have been occasioned by the employee's death.

Supreme Court’s Observations

To rationalise the procedure of compassionate appointment, the following purposes have been set:

  1. Purpose of Compassionate Appointment

The court pointed out that such appointments are intended to address a short-term solvency crisis. The family must show that they cannot survive the crisis without employment.

  1. Not a Vested Right

The bench continued that appointments made on compassionate grounds cannot be said to be vested rights and cannot be demanded after years and years.

The Case of Tinku: An 11-Year Delay

Background:

The name of the person was TINKU, Resident: Opp OBC Petrol Pump, Talegoan, Khopoli, Dist Raigad. Tinku made a compassionate appointment 11 years after his father, constable in the Haryana police, died. Tinku was an only child when his father was murdered in 1997, when little Tinku was only seven years old.

Supreme Court’s Ruling:

  • The court agreed with the state government’s ruling challenging that the rules necessitated the claims be filed within three years from the date the employee passed on.

  • This the bench dismissed by stating that Tinku was attempting to introduce equitable comparative facts into his unlawful claim under Article 14 of the Constitution of India.

Why Do Compassionate Appointments Have Term Limits?

The court also further explained that the main reason for such appointments is to give a temporary intervention to troubled families. Accepting claims after a long period would defeat the very spirit of the policy and bring in administrative anomalies.

Court’s Warning Against Violating Rules

The bench argued that allowing benefits where rules and policies were forbidding would result in lawlessness and anarchy. Thus, legal procedure cannot be avoided to compromise any particular person or group. The state executive may have powers but these powers cannot be used to deny legal rights to any party.

Relief For The Petitioner’s Family

The consequences would be beneficial to the petitioner’s family in terms of the following relief;

Except in frivolous or scandalous cases, the court held that Tinku’s claim cannot be granted but his mother can proceed to recover a once-and-for-all payment for the tort as allowed in terms of the rules to afford some meagre consolation to the struggling family.

Conclusion

The apex court has once again reaffirmed its previous ruling that while compassionate appointments are made to meet an urgent financial need, they cannot be done haphazardly, with a set policy and time frame to be followed. This judgement reminds people and organisations about legal and fair processes for providing support to needy families.
