On the 04th of April 2025, the parliament of India passed one of the most controversial bills in recent history. The name of the bill is the Waqf (Amendment) Bill, and it is related to the properties donated by the people from the Muslim communities. This bill has gone through a lot of emotional arguments, debates, and resistance, but in the end, the fair voting in parliament made the decision about its existence clear.

What Is Waqf?

The word Waqf translates to donations made by the Muslims for charitable or religious purposes to benefit the community as a whole. Hence, the bill is related to the management of Muslim properties.

Such Muslim properties come under the governance of the Waqf Act of 1995, which gave the responsibility of management to various state authorities. The boards responsible for the same are comprised of people from the state, Muslim lawmakers, members of the state bar council, Islamic scholars, and managers of Waqf properties.

What Is The Waqf (Amendment) Bill?

The parliament of India recently passed the Waqf (Amendment) Bill, which was proposed by the BJP government in 2024. The bill was proposed to enhance the quality of management of the Waqf properties, but various Muslim leaders didn’t feel the same and opposed it.

The major changes introduced through the Waqf (Amendment) Bill are laid down below for one’s better understanding and reference.

1. Legal Documentation

Earlier, oral declarations were considered enough for Waqf properties. But under the new bill, proper and legal documentation is required to claim a property as Waqf property. In case of any conflicts, the end judgment lies with the government.

2. No Muslims As Board Members

The bill has proposed not to allow any individual from the Muslim communities to be on the decision boards or tribunals.

3. Registration Of Waqf Properties

The registration system of Muslim properties will be revamped, wherein all the properties as Waqf will be required to be registered within 6 months of the bill turning into a law. Also, requests for new registrations shall be presented to the Waqf board.

Why Is Waqf In Controversy?

Many major opposition parties and infamous Muslim leaders have opposed the bill and are still against it. Congress Leader Mallikarjun Kharge highlighted the fact that the bill was passed because of 288 votes in favour but was contested by a major number of 232.

Lawmaker Asaduddin Owaisi, president of the All India Majlis-e-Ittehaful Muslimeen party, has already challenged the bill in the Supreme Court of India.

The opposing and the supporting parties both have their rationale regarding the Waqf (Amendment) Bill, but only time will tell the future of this bill.
