Supreme Court Clarifies: Preliminary Inquiry Not Mandatory Before FIR Against Public Servants Under Corruption Law

Through its ruling, the Supreme Court of India made it clear that police do not need to conduct a prior investigation to start a criminal case against corrupt public officials under the Prevention of Corruption Act. The Court stated that if we have to evaluate this need depends on the context of every unique case to protect both serious charges and defend against wrong claims of corruption.

During the State of Karnataka's appeal hearing two judges Justices Dipankar Datta and Sandeep Mehta made this judgement. A public employee faced charges because his wealth exceeded what he should possess based on his income. The Karnataka High Court ended the investigation because the authorities failed to perform the necessary cheques first. According to the Supreme Court, a preliminary investigation offers benefits but registrations of cases under the Prevention of Corruption Act can proceed without it. No strict need exists for prior inquiries because enough initial evidence supports filing charges under Indian law.
