How To File A Complaint In Consumer Court? Here IS A Simple Guide!

Justice delayed is often justice denied, but can delay justice sometimes teach valuable lessons? A case from the Madhya Pradesh State Consumer Forum, which took eleven years to resolve, offers insight.

In 2013, a young man from Balaghat, Madhya Pradesh bought shoes for ₹600. Just two days later, the shoe’s sole came off. When he took them back to the shop for exchange, the shopkeeper denied him that chance and even treated him rudely. The boy then filed his complaint against the District Consumer Forum. He was granted some compensation but was still dissatisfied and chose to appeal to the Bhopal-based Madhya Pradesh State Consumer Forum. The case was finally concluded in 2024.

After fighting for his rights for 11 years, the youngster eventually found justice. According to the order of State Consumer Forum: The shopkeeper was ordered by the state consumer forum to pay ₹3040 which includes the original cost of shoes, interest at 6% per year from that date till today amounting to ₹1000 for mental and physical harassment caused due to faulty goods and an additional ₹1000 towards the cost of appeal, though these may look like small amounts compared to what sizeable retailers earn in a day justifies consumers winning.

What Are Your Rights Under The Consumer Protection Act, 2019?

What To Do If A Shopkeeper Refuses To Exchange Faulty Products?

Should a buyer purchase a defective product from an uncooperative seller, they can seek legal redress in the consumer court. The classification of these courts is as follows:

  • District Consumer Disputes Redressal Forum (DCDRF): These are cases where the amount in question is up to Rs 1 crore.

  • State Consumer Disputes Redressal Commission (SCDRC): For Cases with a value of 1 crore to 10 crores.

  • National Consumer Disputes Redressal Commission (NCDRC): Deals with cases involving amounts over ₹10 crore.

How to Register a Complaint Online Using the E-Daakhil Portal

The E-Daakhil portal, launched in 2020 by the Indian government, allows consumers to file complaints online. Here's how to register:

  • Visit the E-Daakhil Portal.

  • To register, click on “Complaint” on the left side. Fill in your name, mobile phone number and email ID for registration.

  • Enter Relevant Details: There will be a drop-down menu that will ask about your wares’ worth along with other specifics relating to your case like attaching supporting documents if needed for example…

  • Submit Your Complaint: Type in the captcha code before pressing the submit button after which they will give you a complaint ID which can be tracked.

How to File a Complaint in District or State Forum

If you prefer not to file your complaint online, here's what to do.

  • Write Your Complaint: Write your complaint on plain paper, notarize it, and attach the purchase receipt along with any relevant documents.

  • Submit the Complaint: You can submit the complaint yourself or through an authorized agent at the office of the District or State Forum. Ensure that you obtain an original bill for the goods purchased.

  • Appeal If Necessary: An appeal against the order of the District Forum lies with the State Consumer Disputes Redressal Commission (SCDRC) within 30 days. The cost of court fees when filing complaints is different according to the amount in dispute.

How to Complain to the National Consumer Disputes Redressal Commission (NCDRC)

  • Disagreeing with the decision of the State Forum, you can file an appeal within 30 days.

  • The fee for filing a complaint in NCDRC is ₹5000.

  • Within 30 days, one may also prefer appealing against NCDRC’s order in the Supreme Court.
