Noida Property Registry

Noida property registrations have been suspended since May 2022 due to a legal tangle between the Noida authority and the local stamp and registry office. This has resulted in thousands of homebuyers struggling to register their purchased flats despite making payments as per builder schedules.

Noida, the bustling planned city neighbouring India’s capital, has emerged as a much sought-after real estate destination owing to its infrastructure growth, connectivity to Delhi, and presence of major corporate campuses over the past decade.

In a major relief to thousands of homebuyers in Noida, 42 out of 57 real estate developers have agreed to clear their outstanding dues to the Noida Authority by May 12.

This development raises hopes that the long-stalled registries of flats in Noida may finally reopen after 3 years.

Latest Updates

As per the latest updates, Noida will restart accepting property registrations for conveyance deeds, sales agreements, and other documents from August 1st week after a High Court-appointed IAS officer takes charge as the designated Officer on Special Duty (OSD).

In April 2022, the Bar Council of UP declared a strike across all stamp and registry offices in the state as they demanded better pay and work benefits on par with government lawyers.

This resulted in property registrations being halted across UP, including major regions like Lucknow, Agra, Ghaziabad, and Noida.

But, while the strike was called off in a few weeks after government assurances, registrations did not resume in Noida as the local registry demanded payment dues worth Rs. 260 crores from the Noida authority collected over 20 years.

With the Noida administration unwilling to pay this amount, citing a lack of adequate audit-proof, homebuyer registrations remained stuck despite making timely payments to builders as per contractual obligations.

Action By Authority

The Noida Authority had directed builders to repay all dues before May 12th to enable them to begin the registration process for homebuyers awaiting possession.

16 builders have already paid partial dues worth crores of rupees for their respective projects. If all goes well, buyers can expect their flat registries by the end of August.

For context, house registries have remained halted in Noida since 2021 due to non-payment of land dues by realtors. This affected almost 50,000 homebuyers whose investments got stuck even after full payment to builders.

In December 2023, the UP government intervened, asking authorities to reopen registries within 90 days if a 25% upfront payment is made.

Some of the major builders who have currently paid partial dues include Paramount Propbuild (Rs 8.1 crore), Omaxe Buildwell (Rs 11.45 crore), Pan Realtors (Rs 4 crore), and SDS Infratech (Rs 9 crore).

This will enable registry applications for their projects. The Noida Authority has permitted registry requests for 13,600 homes so far.

Homebuyers have already been asked to prepare documentation like conveyance deeds in advance to avoid last-minute hassles once Noida registrations resume. This will prevent a pileup of applications and resultant delays after the restart.

How To Apply For Property Registration In Noida?

Interested individuals can apply for property registration in Noida through both, online and offline platforms.

Online Procedure

  1. Visit the official website of the Stamp and Registration Department.
  2. Click on ‘Property Registration Application Portal’.
  3. Click on ‘New Applicant’ and fill in your details.
  4. Upload supporting documents.
  5. Pay the stamp duty fee online through debit/credit cards, UPI, or net banking.
  6. Book an appointment for the physical verification of documents at the sub-registrar’s office.
  7. Visit the sub-registrar's office on the day of the appointment with the necessary documents.
  8. After successful verification, you’ll receive the registered sale deed.

Offline Procedure

  1. Pay the stamp duty fee online through the official website of the Stamp and Registration Department.
  2. Collect all required documents like the signed sale deed with all signatures, ID proofs, PAN cards, etc.
  3. Visit the sub-registrar’s office with the buyer, sellers, and the 2 witnesses.
  4. Submit the documents for verification.
  5. After successful verification, you’ll receive the registered sale deed.

Transfer Charges for Property Transfers in Blood Relation in Noida

The transfer charges for property transfers among blood relatives come with certain benefits such as the transfer charges reduced to half the original charges to simplify the property transfers among blood relatives.

Documents Needed

Applicants need to submit some supporting documents to successfully apply for the registry of property in Noida. The list of those documents is as follows:

  • Sale deed
  • Id proofs
  • Address proof
  • PAN card
  • No objection certificate
  • Encumbrance certificate
  • Power of attorney (if needed)
  • Receipts of stamp duty and registration fee payment

Applicants can pay the stamp duty and registration fee online for the registry of property in Noida by following the steps mentioned below:

  1. Visit the official website of the Stamp and Registration Department.
  2. Navigate to the e-payment section.
  3. Choose the type of payment.
  4. Fill in the required details.
  5. Pay the amount through debit/credit cards, UPI, or net banking.

Reduced Stamp Duty In Noida & Greater Noida

People have been demanding the state government to reduce the fee of stamp duty and registration so that more people can avail property registrations. The state government listened to the demands and reduced the fee imposed in the form of stamp duty and registration.

At present, the rates are:

  1. For Men: 7% of the property’s market value
  2. For Women: 6% of the property’s market value

Refund On Stamp Duty & Registration Charges In Noida, Greater Noida

The state government has provisions for refunding the stamp duty and registration fee charged but only in some instances. Those instances are:

  • Transaction cancelled or property sale not executed.
  • A clerical error in the stamp paper or e-stamp.
  • Property documents not registered within the specified time frame.
  • Duplicate stamp papers.

Uttar Pradesh's Stamp Duty Laws and Property Value

The stamp duty in Uttar Pradesh is governed by its state laws and the rates are based on various factors such as the location of the property, the type of property, and the gender of the buyer. They are applied as:

  • Calculation of stamp duty: It is calculated by taking into consideration two things, the sale price of the property and the set minimum government rate for property transactions.
  • Discounts on stamp duty: The state of UP offers a 1% discount on stamp duty to women and hence they pay 6% instead of 7%. Agricultural lands also have comparatively lower stamp duty.

Property registration isn’t an easy decision and needs to be taken only after uncovering and considering all the details. Some tips before going for a registry of property in Noida are mentioned below as extra help:

  • Legality: Ensure that the property and the developer are registered with UP RERA and everything is within the boundaries of the law.
  • Approvals: Ensure that the property has all the needed government approvals like from the Noida authority, etc.
  • Calculate costs: Calculate the stamp duty and registration fee as per the criteria for proper estimations.
  • Future of the property: Think about the resale value of the property which is usually based on location and then invest.
